These Terms apply to anyone who registers, visits, browses, searches or otherwise uses the Service (“user” or “you”), whether you are looking to offer renovation or contracting services (a “Contractor”) or hire a Contractor for such services (a “Homeowner”).
These Terms also incorporate all other posted terms, policies and rules, including our Terms & Conditions for Contractors, available at https://www.maxkempgroup.com/terms-and-conditions. If you are using the Service on behalf of an organization, “you” and “user” include that organization too. The Service is owned and managed by MaxKempGroup (“we”, “us”, or “MaxKempGroup”). Details about how we handle personal data are described in our Privacy Policy https://www.maxkempgroup.com/privacy-policy.
By using the Service, you confirm and guarantee that you:
Have read, understood, and agree to be legally bound by these Terms;
Have the authority to accept these Terms for your organization if you are using the Service on its behalf;
Are at least the age of majority in your jurisdiction;
Are either the owner of the property or have permission from the owner to manage renovations if acting as a Homeowner;
Will comply with these Terms and all applicable laws.
A printed version of these Terms is admissible in legal or administrative proceedings the same way as other official business records.
If you disagree with any part of these Terms, please stop using the Service immediately.
Homeowners can submit renovation requests by providing accurate details through the Service, including location, type of work needed, and contact information. After submitting a request, Contractors may contact you to discuss providing those services.
Any agreements or contracts made are strictly between Homeowners and Contractors. MaxKempGroup is not a party to these contracts and does not guarantee the quality, timing, pricing, materials, or completion of any work by Contractors. It is the sole responsibility of both Homeowners and Contractors to communicate, set terms, and resolve any issues. Using the Service does not guarantee that a Contractor will respond or agree to work with you.
Contractors work independently and must not claim to represent or bind MaxKempGroup in any way. Contractors may not present themselves as our employees, partners, agents or representatives. Neither party may bind the other to any contract or obligation.
Homeowners must give accurate, up-to-date information about services received or not received. For example, please inform us if a Contractor asks you to submit false information about services that were not actually provided.
We control and own the Service, including all text, data, images, graphics, logos, videos, sounds, software, design, and other content (the “Content”). All Content is protected by intellectual property laws and is either owned by us or licensed to us (except personal data and your User Content, as defined below). You must not remove copyright or proprietary notices from any Content.
Subject to your compliance with these Terms, we grant you a limited, personal, non-transferable, non-exclusive, revocable license to access and use the Service and its Content solely to learn about the Service, connect with Contractors or Homeowners, and for no other purpose.
You may not:
Use automated tools or manual processes to copy, scrape, or monitor Content without our written permission;
Try to bypass or disable any security features of the Service;
Probe or test the Service’s security or interfere with its functioning;
Use the Service to create or promote competing services;
Sell, sublicense, modify, reverse engineer or adapt the Service except as allowed by law;
Impersonate anyone, falsify information or misrepresent your relationship with MaxKempGroup;
Remove or alter any notices on the Content.
Violation of these Terms may result in suspension or termination of your access and potential legal action.
You may provide content, comments or feedback through the Service (“User Content”). User Content may be visible to other users.
By submitting User Content, you grant MaxKempGroup an irrevocable, worldwide, royalty-free, non-exclusive license to use, copy, modify, share, store, display and create derivative works from your User Content, in any format and on any platform, without further notice or compensation to you.
By providing User Content, you confirm that:
It is free of viruses or harmful elements;
It does not violate third-party rights;
You own or have the rights to share it under these Terms;
You are responsible for any personal data in your User Content and have obtained any required consents.
We may remove or decline to use your User Content at our discretion.
You must not use the Service to:
Post obscene, explicit or offensive content, hate speech, or threats;
Spam or collect personal data without consent;
Make unsolicited calls outside permitted hours (before 8 a.m. or after 9 p.m. local time);
Spread false or misleading information or promote illegal activity;
Impersonate others or misrepresent your relationship with MaxKempGroup;
Post off-topic content on discussion boards;
Promote contests, ads, or schemes without written consent;
Use bots or scraping tools without permission;
Overload or disrupt the Service or its security.
We may moderate Content but are not obliged to do so.
The Service and Content are provided “as is” and “as available.” We make no guarantees about the Service’s uninterrupted operation, accuracy, or security. MaxKempGroup does not guarantee any Contractor’s work and does not handle disputes between users.
MaxKempGroup is not liable for any errors or omissions in the Content. You are solely responsible for following laws and contracts. Contractors are responsible for their staff’s actions.
To the maximum extent allowed by law, MaxKempGroup is not liable for any indirect or consequential damages arising from your use of the Service. If our liability is found valid, it will not exceed the amount you paid to MaxKempGroup in the past year.
You agree to defend and indemnify MaxKempGroup and its partners against any claims, damages, or expenses related to your breach of these Terms, misuse of the Service, violation of laws or third-party rights, or disputes with Contractors or Homeowners. You agree to cooperate fully if we handle our own legal defense.

You and MaxKempGroup agree that all disputes will be resolved through binding arbitration under the Federal Arbitration Act. Before filing arbitration, you must try to resolve the dispute informally by contacting us. If not resolved within 30 days, either party may begin arbitration through the American Arbitration Association in Philadelphia, Pennsylvania under Delaware law.
Disputes must be arbitrated individually — no class actions. If a court finds the class action waiver unenforceable, the arbitration provision is void. Exceptions: either party may bring claims for intellectual property infringement or small claims.
You can opt out of arbitration/class action waiver within 30 days by emailing us with the subject “ARBITRATION AND CLASS ACTION WAIVER OPT-OUT.”
By using the Service, you agree to receive emails about the Service and updates to these Terms. You may unsubscribe from promotional emails at any time.
Some Service functions rely on third-party services. We are not responsible for any third-party sites or their terms.
We may transfer our rights under these Terms to another entity. We may update these Terms at any time — material changes will be notified in advance. Continued use means you accept the revised Terms.
If any provision is found invalid, the rest remain enforceable. These Terms are governed by the laws of Delaware and applicable U.S. federal laws.
